Acceptance and scope
These Terms apply to Websterly, websterly.dev, related subdomains, and any hosted or published experiences that Websterly makes available to you as part of the service.
By accessing Websterly, creating an account, starting a project, or purchasing a paid plan, you agree to these Terms. If you use Websterly on behalf of a company or team, you represent that you have authority to bind that organization to these Terms.
Accounts, eligibility, and security
You must be legally able to enter into these Terms and provide accurate account information. Keep your login credentials secure and do not share access in a way that bypasses your plan limits or security controls.
You are responsible for activity that occurs through your account unless it resulted directly from Websterly's failure to use reasonable security measures. Contact support promptly if you believe your account has been compromised.
- Provide current and truthful signup, billing, and contact details.
- Maintain the confidentiality of your password, session tokens, and connected integrations.
- Use Websterly only in compliance with applicable laws, contracts, and platform policies that apply to your content or business.
The Websterly service
Websterly provides AI-assisted tools for generating, editing, deploying, and managing web and application projects. Features may include code generation, collaboration, publishing, hosting-related workflows, analytics setup, and connections to third-party platforms such as GitHub, Vercel, Supabase, AI model providers, and billing providers.
We may add, remove, or modify features over time. Some features may be experimental, beta, or dependent on third-party services that Websterly does not control.
Your content and AI-generated output
You retain ownership of the prompts, files, uploads, project data, and other content you submit to Websterly, and you retain any rights you have in the output generated for you. You grant Websterly a limited license to host, store, process, reproduce, and transmit that content only as needed to operate, secure, improve, and support the service for you.
AI-generated output can be incomplete, inaccurate, or similar to output provided to other users. You are responsible for reviewing, testing, and validating output before publishing it, relying on it in business decisions, or using it in legal, financial, medical, safety-critical, or other high-risk contexts.
- You must ensure your content and outputs do not infringe third-party rights or violate applicable law.
- If you publish a site or app built with Websterly, you are responsible for that site's content, claims, compliance, and end-user notices.
- Do not submit highly sensitive personal data unless you have independently confirmed Websterly is appropriate for that use.
Acceptable use restrictions
You may not misuse Websterly or use it in a way that harms the service, other users, or third parties. We may investigate activity that appears abusive, unlawful, insecure, or inconsistent with these Terms.
- Do not upload malware, phishing content, unlawful material, or content intended to exploit, harass, defraud, or harm others.
- Do not probe, scan, reverse engineer, or circumvent security, rate limits, payment controls, or plan restrictions.
- Do not use Websterly to build or distribute spam systems, credential theft tools, or other abusive automation.
- Do not interfere with Websterly's infrastructure, other customer projects, or third-party services connected through the platform.
Subscriptions, billing, and refunds
Some Websterly features require a paid subscription or other paid purchase. Polar acts as merchant of record for those transactions, which means checkout, billing collection, taxes, and certain purchase records are managed through Polar and subject to the checkout terms shown to you at the time of purchase.
If you start a recurring subscription, you authorize recurring charges until you cancel. Prices may change prospectively, and changes will apply no earlier than your next renewal unless a different timing is clearly disclosed to you.
Unless otherwise required by law or expressly stated at checkout, fees are non-refundable. If a payment fails or a charge is reversed, Websterly may suspend or downgrade access to paid features.
- You can cancel from the tools Websterly or Polar makes available for your subscription.
- After cancellation, your subscription will stop renewing, and paid access may end immediately or at the end of the already-paid period depending on the checkout terms in effect for your purchase.
- Taxes, VAT, and other transaction obligations may be collected or calculated by Polar where applicable.
Third-party services and integrations
Websterly depends on third-party providers for infrastructure, AI model access, authentication, email delivery, analytics, payments, and optional integrations. When you connect GitHub, Vercel, Supabase, or similar services, you direct Websterly to exchange data with those providers on your behalf.
Your use of third-party services remains subject to those providers' own terms, privacy notices, and technical limits. Websterly is not responsible for third-party outages, policy changes, or data handling outside Websterly's control.
Availability, beta features, and disclaimers
Websterly is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not guarantee uninterrupted service, error-free output, or that every generated project will meet your expectations, requirements, or compliance obligations.
From time to time we may suspend the service for maintenance, security, infrastructure changes, abuse prevention, or legal reasons. Beta and early-access features may be more limited, unstable, or changed without notice.
Suspension and termination
You may stop using Websterly at any time. Websterly may suspend or terminate access if you violate these Terms, create security or legal risk, abuse the platform, fail to pay required fees, or if continued service is no longer commercially or technically feasible.
Upon termination, your right to access the service ends, but provisions that by their nature should survive will remain in effect, including provisions about ownership, payment obligations, disclaimers, limitations of liability, and dispute-related terms.
Limitation of liability
To the maximum extent permitted by law, Websterly will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, use, or data arising from or related to the service.
To the maximum extent permitted by law, Websterly's total liability for all claims arising out of or relating to the service will not exceed the greater of the amounts you paid to Websterly through Polar during the 12 months before the event giving rise to the claim or USD 100. Nothing in these Terms limits liability that cannot be limited under applicable law.
Changes to these Terms and contact information
We may update these Terms from time to time to reflect changes to Websterly, the law, or our business practices. The updated version becomes effective when posted, unless a later effective date is stated. If we make a material change, we may also provide notice through the service or by email.
